Towerstream Service Trial Agreement & Service Order
This Service Trial Agreement ("Agreement") and the attached Schedule A: Service Order ("Schedule A") are made between Towerstream ("Company") and the undersigned customer ("Customer").
This integrated document outlines the terms of the 14-Day Risk-Free Trial and serves as the official Service Order Form for the products and services selected herein.

Service Trial Agreement Terms
1. 14-Day Risk-Free Trial Period The Customer's 14-day, risk-free trial ("Trial Period") begins on the date that the shipping carrier confirms the Customer's Towerstream Failover has been delivered. The Company may send email reminders to the Customer regarding the status of their Trial Period.
2. Initial Payment and Billing This is a risk-free, not a free-of-charge, trial. Upon execution of this Agreement, the Customer agrees to be billed for the first month of the service plan selected in Schedule A, plus any applicable taxes and fees. This initial payment is subject to the refund conditions outlined in Section 3.
3. Cancellation and Refund Guarantee The Company offers a "Bulletproof Guarantee" for the Trial Period with the following terms:
  • a. Cancellation Procedure: To cancel service and request a refund, the Customer must contact the Towerstream support team at (866) 848-5848 or support@towerstream.com on or before the 14th day of the Trial Period.
  • b. Equipment Return: Upon cancellation, the Company will provide the Customer with a prepaid return postage label. The Customer must ship the Hardware back to the Company in its original box and in good working condition (reasonable wear and tear excepted).
  • c. Refund Eligibility and Deadline: To qualify for a full refund of the initial payment, the Towerstream Failover must be shipped back to the Company within 72 business hours of the Customer's cancellation call.
  • d. Restocking Fee: If the Customer fails to ship the device within the 72-business-hour timeframe as required in section 3(c), a $100.00 restocking fee will be deducted from the Customer's refund.
4. Plan Specifications
  • Data Allowance: The data allowance is determined by the plan selected by the Customer in Schedule A.
    • 1G Plan: Includes 1 GB of premium network data per month.
    • 5G Plan: Includes 5 GB of premium network data per month.
  • Data Overage: Data usage beyond the selected plan's allowance will be billed at a rate of $6.00 per additional GB, and bandwidth may be throttled.
5. Equipment The Company will provide the Inseego FX3100 5G/LTE router and a Skazeke 15000mAh UPS Battery Backup ("Hardware"). The Hardware remains the property of Towerstream at all times unless the Customer fails to return it as outlined in Section 8.
6. Governing Terms and Policies The Customer's primary service relationship is with Towerstream. As a condition of service, the Customer acknowledges that Towerstream provides its service using the network infrastructure of a third-party partner, Albion Ventures, LLC. Therefore, the Customer agrees to be bound by the Albion Ventures, LLC Terms of Service (Appendix A) and Acceptable Use Policy (AUP) (Appendix B), which exclusively govern the Customer's use of the underlying network.
7. End of Trial Period and Service Conversion
  • a. To Continue Service: If the Customer does not cancel the service by the end of the 14-day Trial Period as described in Section 3, this Agreement will automatically convert to a standard monthly service agreement for the plan chosen by the Customer in Schedule A. The Customer will be billed monthly thereafter.
  • b. To Discontinue Service: The Customer must follow the Cancellation Procedure outlined in Section 3.
  • c. Cancellation After Conversion: If the Customer converts to a standard monthly service agreement (per Section 7.a) and subsequently terminates the month-to-month service within the first twelve (12) months following the end of the Trial Period, the Customer agrees that Towerstream may charge a $150.00 Restocking Fee. This fee is distinct from the fee described in Section 3.d.
8. Failure to Return Hardware This section is distinct from the Restocking Fee (Section 3d). If service is discontinued and the Customer fails to return the Hardware within 30 days of cancellation or returns the hardware in a damaged condition, the Customer agrees to be invoiced for the full replacement value of the Hardware.
